                                        JUDGMENT

1. This revision petition is directed against the order passed by the

learned first appellate Court dtd.30.10.2003 whereby the learned

appellate Court reversed the trial Court’s order under Order 39 Rule 2

(d) C.P.C. dtd.3.8.2001.

2. Admittedly, the second appeal under Section 100 C.P.C.

against the main judgment of the first appellate Court dated

30.10.2003 passed in appeal No.21/2003 is pending in this Court,

namely, S.B. Civil Second Appeal No.353/2004 – Narendra Kumar

V/s Govind Kant which was admitted on 16.8.2005.

3. Having perused the impugned order dtd.30.10.2003, this Court

finds no ground to interfere with the same in the present revision

petition. The revision petition is accordingly dismissed. No order as

to costs.
