In view of the fact that the notices
have been served on some of the heirs of the
appellant for the purposes of engagement of
fresh counsel and for that name of another
counsel for the appellants Mr. Naresh Kumar
Sinha is also appearing in the cause list,
there will be no need to now await service
of notice on other heirs and legal
representatives of the sole appellant.

That being so, this appeal being of

the year 1974, if it is ready even without

paper-book, should be listed for final

hearing on 7th March 2011 within first five

cases.
