2. 09.08.2010. Heard learned counsel for the
petitioner and counsel appearing for the State.
The petitioner is languishing in jail
since 03.05.2010 in a case registered under
Section 364 of the I. P. C. and Section 3(X) of
SC/ST (Prevention of Atrocities) Act.
It is alleged that for getting
informant’s son employed, the petitioner took
the victim 3-4 months prior to the lodging of
the case. When the informant enquired then
800/- rupees were offered by the petitioner’s
side.
It is submitted by the learned counsel
for the petitioner that the informant’s son was
working as domestic help in the house of the
petitioner and subsequently he committed theft
of some jewellery and cash and in order to over
come that situation, the present case has been
lodged. It is further submitted that the
petitioner is an agriculturist and having no
criminal antecedent and he has falsely been
implicated in the present case.
Considering the aforesaid submissions,
let the petitioner, Naresh Singh, be released

on bail on furnishing bail bond of Rs. 10,000/-
(Ten Thousand) with two sureties of the like
amount each to the satisfaction of the learned
C.J.M., Nawada, in connection with Rajauli P.S.
case No. 128 of 2009, G.R. No. 1459 of 2009.
Learned court below will be at liberty
to cancel the bail of the petitioner if the
petitioner fails to appear during trial on
three consecutive dates.
