Mr.Pathak, learned advocate for the applicant. Rule.

Having
regard to the submissions made by the learned advocates for the
respective parties and considering the averments made in the
application, the order dated 24.02.2011 passed in Special Civil
Application No.14805 of 2010 is recalled. The application is allowed.
The relief prayed for in Para-4(b) is granted. Rule is made absolute
to the aforesaid extent. The application stands disposed of.

The
Registry is directed to restore the proceedings of Special Civil
Application No.14805 of 2010 to its original file. The petition to be
listed before appropriate Bench in due course.
