By means of this writ petition the petitioner has challenged interim order
passed by the State Consumer Disputes Redressal Commission ,Uttar Pradesh
by which after considering the facts in detail the Commission has directed the
petitioner to deposit Rs.1,00,000/-. Learned counsel for the petitioner submits
that he has already depsoited Rs.25,000/- . After going through the record we
direct the petitioner to deposit Rs.75,000/- more as the Commisison has not
excluded the said amount from Rs.1,00,000/-.
Considering the facts and circumstance of the case we direct the State
Consumer Disputes Redressal Commission, Uttar Pradesh to decide the
appeal of the petitioner expeditiously say within a period to two months from
the date of production of a certified copy of this order in accordance with law
and shall also decide the question as to whether the complainant is a consumer
or not in view of the law laid down in Purvanchal University ,Jaunpur v.
Shabeena Khatoon decided on 9.9.2009 (copy of which shall be filed by the
appellant before the Commission).
With the aforesaid direction the writ petition is disposed of finally.
