ORAL ORDER
The
applicant has taken out this application with a prayer that the order
dated 27.2.2009 passed in SCA No. 1784 of 2009 may be recalled.
In
view of the averments made in the application and the submissions
made by Mr. Japee, learned advocate for the applicant, case for
recalling the order dated 27.2.2009 has been made out. Hence,
application is allowed in terms of the relief prayed for in paragraph
6(b). The order dated 27.2.2009 is recalled and the proceedings of
SCA No.1784 of 2009 are restored to file. The petition being SCA
No.1784 of 2009 be listed for admission hearing on 24th
March, 2009 in First Board. It is clarified that if the hearing of
the petition is not attended on 24th March, 2009, the
petition shall automatically stand dismissed.
Present
application is accordingly disposed of.
