02. 13.10.2011 Petitioner is apprehending his arrest in a case

registered under Sections 341, 323, 379, 504, 506/34 of

the I.P.C. and Section 3 (i)(x) of the S.C. & S.T.(Prevention

of Atrocities) Act.

It is alleged by the informant being Panchayat

Secretary, while distributing coupons, was protested by

petitioner and others as to why the name of the wife of

the petitioner was not included in the beneficiaries list

and demanded coupons. On protest the accused persons

assaulted the informant by fists and slaps. It is also

alleged that Arvind Yadav and Krishna Kumar assaulted

with fists and slaps and took away certain coupons, keys

and other things.

It is submitted by learned counsel for the

petitioner that the specific accusation of assault and

abuse is not against the petitioner but against 30 to 40

people. Moreover due to political rivalry the petitioner has

been roped since the wife of the petitioner has succeeded

in the Panchayat election. It is further submitted that

petitioner has no criminal antecedent.

Considering the fact that accusation is
against 30 to 40 people and specific accusation of assault

is against two other persons, let the petitioner namely

Nirmal Kumar, in the event of his arrest or surrender

before the Court below within a period of 12 weeks from

today, be released on anticipatory bail on furnishing bail

bond of Rs. 10,000/-(ten thousand) with two sureties of

the like amount each to the satisfaction of Chief Judicial

Magistrate, Madhepura in connection with Madhepura

Bharrahi P.S.Case No. 264 of 2011.
