Sri Ashok Khare, learned counsel for the petitioners submits that
by order dated 16.05.2010, it was directed that the salary will be
paid from the office of the Deputy Chief Medical Officer. Certain
aggrieved persons filed a writ petition and this Court has directed
to consider and decide the representation. Without deciding the
representation, now Chief Medical Officer Kushiagar has passed
the order dated 21.07.2010 directing that the salary will be paid
from the concerned Primary Health Centre.
In such circumstances, petitioners are entitled for interim relief.
Till the next date of listing the operation of the order dated
21.07.2010 shall remain stayed.
