                               J U D G M E N T

In this writ petition, I have passed the following interim order on

9-7-2008:

“The petitioner applied for a passport in his name, in which
he had put his permanent address as his residential address.
However, he is presently residing with his uncle Sri. V.T. Baby and
aunt Smt. Vijaya Baby for the purpose of pursuing his studies. The
passport was forwarded to his permanent address, which was
returned as the petitioner was not available at his permanent
address. The petitioner, therefore, filed this writ petition seeking
a direction to the respondents to forward the passport to the
petitioner in the address of his uncle.

2. The learned asst. Solicitor General would contend that as
per the notification issued by the Government, the passport has to
be forwarded only by registered post in the address shown in the
application for passport and therefore, they cannot agree to the
request of the petitioner.

I am of opinion that this difficulty can be overcome, if the 1st
respondent makes available the passport to the learned Asst.
Solicitor General, who can handover the passport to the learned
counsel for the petitioner in open Court. For facilitating this, the
1st respondent shall see that the passport is produced before this
Court on 28-7-2008. Post on 28-7-2008.”

2. Today, the learned Assistant Solicitor General produces the

passport in the name of the petitioner in Court. As per the direction

of this Court, the learned Assistant Solicitor General hands it over to

the learned counsel for the petitioner and the learned counsel for the

petitioner accepts the same. This handing over of the passport shall

be considered as valid issue of the passport to the petitioner and the

1st respondent shall stand relieved of his responsibility in respect of

handing over of the passport to the petitioner. The writ petition is

disposed of as above.
