It
is informed that the basic question `whether electricity dues
constitute a charge on the property so far as the transferor and the
transferee of the unit are concerned’ has been referred to Three
Judges Bench of the Hon’ble Supreme Court in Civil Appeal
Nos.5312-5314 of 2005, Civil Appeal No.2108 of 2004, Civil Appeal
No.2109-2110 of 2004 and Civil Appeal No.7303 of 2005.
In
the circumstances, we direct to list this case along with Letters
Patent Appeal No.1322 of 2009, Letters Patent Appeal No.1518 of 2006
and Letters Patent Appeal No.2196 of 2009 and other similar cases
where similar issues are involved and pending before the learned
Single Judge be placed on 29th January, 2010.
