ORAL
ORDER

This
Court has passed an order on 7/12/2007 directing the OL to get
clarifications from the valuer in respect of issues raised therein.
Pursuant to that order, the OL wrote a letter to the valuer on
17/12/2007. Mr.Mrugesh Jani, learned Advocate appearing for the OL
submits that till date no reply has been received by OL from the
valuer. It is very unfortunate that a firm like GITCO does not
respond promptly to the order passed by this Court or even letter
written by the OL. When certain queries raised by the Court it is
their bounden duty to respond to those queries promptly otherwise no
useful purpose would be served of their valuation. Therefore, the OL
is once again directed to rigorously pursue the matter with the
Valuer and the concerned Valuer, only with a view to maintain their
reputation in the market, should promptly respond to the queries and
the reply of the valuer be placed before the Court on the next date
of hearing i.e. 24/01/2008.

It
is made clear that despite this order, if no response is received
from the valuer, the Court would pass appropriate order on the next
day. Copies of this order and earlier order be sent to the valuer
along with OL’s letter. Matter is adjourned to 24/01/2008 at 2:15
p.m.
