                                JUDGMENT

Petitioner is the daughter of one Sri.K.Pushpakaran who died

in harness while working as driver in ICDS Project Office,

represented by the third respondent herein. Petitioner’s mother is

the first wife of Sri.K.Pushpakaran and after divorce

K.Pushpakaran married one T.K. Geetha in whom he has a minor

child aged 12 years. Ext.P1 and P2 would show that retirement

benefits due under the account of K.Pushpakaran has been

apportioned between the second wife and the petitioner.

Petitioner is qualified to be considered for appointment to a

ministerial post in the Government and Ext.P7 application is

submitted in the prescribed form. This is followed by Ext.P8

representation.

2. I have heard learned counsel for the petitioner and the

learned Government Pleader.

3. The writ petition is disposed of in the following terms:

1) Third respondent shall process Ext.P7 and forward the

same along with remarks to the second respondent within one

month from the date of receipt of a copy of this judgment.

2) Thereupon the second respondent shall issue notice to

the second wife of K.Pushpakaran namely Smt.T.K.Geetha and

after conducting enquiries forward Ext.P7 to the first respondent

along with his remarks within six weeks from the date of receipt

of the application from the third respondent.

3) Thereupon the first respondent shall pass orders on

the petitioner’s application for appointment under the dying in

harness scheme in accordance with law, within two months from

the date of receipt of the same.
