ORAL ORDER

Counsel
for the petitioner submitted that the petitioner has no criminal
antecedents, investigation is over and charge-sheet is filed. He
further submitted that co-accused Bhima Sidi Modha has been granted
bail by this Court by order dated 16.3.2011. Counsel further
submitted that the petitioners are appointed as Muster Clerks in
October 2010 whereas even as per the FIR the period during which the
offence took place is shown as from 28.5.09 to 31.8.10.

2. Considering
the above prima facie aspects of the matter, the petitioners are
ordered to be released on bail in
connection with C.R.No.I-46 of 2010 of Kutiyana Police Station on
furnishing bond of Rs.10,000/- each (Rupees Ten thousand only)
with one surety of the like amount to the satisfaction of the lower
Court and on conditions that they shall :

[a] not
take undue advantage of their liberty or abuse their liberty;

[b] not
act in a manner injurious to the interest of the prosecution;

[c] maintain
law and order;

[d] mark
their presence before the concerned Police Station on every 1st
and 15th day of English Calender month between 11.00 a.m.
And 2 p.m .

[e] not
leave the State of Gujarat without prior permission of the Sessions
Judge concerned;

[f] furnish
the address of their residence at the time of execution of the
bond and shall not change the residence without prior permission of
this Court;

[g] surrender
their passport, if any, to the Lower Court immediately.

3. If
breach of any of the above conditions is committed, the Sessions
Judge concerned will be free to take appropriate action in the
matter.

4. Bail
before the Lower Court having jurisdiction to try the case.

Rule
is made absolute.

Direct
service is permitted.
