This petition has been filed under Section 482 Cr.P.C. for

quashing complaint No.691 of 2001 (Annexure P-1) titled ‘Kishan Chand

Sharma Vs. Om Pakash & Others’ pending in the Court of Judicial Magistrate,

IInd Class, Faridabad, and summoning order dated 31.10.2006 (Annexure P-2).

Learned counsel for the respondent has pointed out that

evidence is being recorded and therefore, considering the stage of the case and

the fact that the Trial Court is fully seized of the matter, this petition ought not

to be entertained.

Considering the stage of the trial, this petition is

dismissed.
