Prayer has been made for release of the petitioner

and his six family members, his co-workers Kanwar Pal son of

Hirda alongwith and his three family members, Sukh Pal son of

Sadhu Ram alongwith his five family members, Bhopal son of

Mukhtiara alongwith his five family members, Rawinder son of

Sant Dass alongwith his five family members, Vijay Pal son of

Mangu alongwith his six family members, Om Singh son of Hirda

alongwith his eight family members, Amrish son of Palu Ram

alongwith his five family members and Bir Singh son of Baru

alongwith his six family members, who, according to the

petitioner, have been illegally detained by Hans Raj, Sita Ram

Vijay, owners/proprietors and Rajbir, Jamadar of brick kiln under

the name and style of M/s BABA situated at village Pinjani Kalan,

Police Station Dhuri, District Sangrur.

According to the petitioner, he and the other

aforementioned detenus had been working at the brick kiln in

question since 18.8.2010 for making raw bricks. They were

assured that for the work, to be done by them, they would be paid

wages as per government rates. However, for the last eight days,

they had no work to perform. When they requested the owners

and the Jamadar of the brick kiln to allow them to leave the said

place for going to their respective homes and earning their

livelihood, they were not allowed to do so. Rather, they were

beaten by the owners/proprietors and the Jamadar of the kiln

besides other undesirable elements.

At the asking of the Court, Mr. P.S. Paul, Deputy

Advocate General, Punjab, who is present in the Court, accepts

notice.

After going through the letter dated 29.8.2011 sent by

the petitioner through post and hearing learned State counsel, the

present petition is disposed of with a direction to the District

Magistrate, Sangrur to conduct an enquiry in respect of the

allegations levelled by the petitioner in the present petition and

take necessary action thereupon within a period of two weeks

from the date of receipt of a copy of the order.

A copy of the order, duly attested by the Special

Secretary, be handed over to learned State counsel for

compliance.
