We have heard learned counsel for the petitioner and learned
standing counsel appearing for respondents.
This petition has been filed by the petitioner challenging the
cancellation of fair price shop agreement.
The petitioner has an adequate alternative remedy of filing an
appeal before the Commissioner.
In case the petitioner files an appeal before the Commissioner
within a period of one month from today it shall be decided by the
Commissioner within a further period of two months. The fair
price shop of the petitioner which has been cancelled shall not be
allotted to any one else till the disposal of the appeal. However, the
fair price shop of the petitioner shall be attached to some other fair
price shop agreement holder for fair distribution of essential
commodities.
With the aforesaid directions the writ petition is finally disposed
of.
