                               JUDGMENT

The challenge in this writ petition is against Ext.P5, a stop

memo issued by the 1st respondent against the quarrying operations

of the petitioner.

2. According to the petitioner, he is quarrying on the

strength of Ext.P4, a permit issued by the competent authority. It is

seen that aggrieved by Ext.P5, the petitioner has already moved the

2nd respondent by filing Ext.P6 and orders on Ext.P6 have not been

passed so far. It is in these circumstances the writ petition has been

filed.

2. Since the petitioner has already moved the competent

authority by filing Ext.P6, I do not think it necessary for this court to

enter into the merits of the controversy for the present. Therefore, I

dispose of the writ petition directing that the 2nd respondent shall

take up, consider and pass orders on Ext.P6. This shall be done as

expeditiously as possible, at any rate, within four weeks of

production of a copy of this judgment.

Petitioner shall produce a copy of this judgment before the

2nd respondent for compliance.
