                               JUDGMENT

Petitioner has approached this court seeking a direction to

the respondents to conduct election before the expiry of the

period stipulated in Ext.P2. A direction is also sought to conduct

election before 21/11/2007, the extended period of second

respondent. According to the petitioner who is stated to be a

member of the second respondent bank, proceedings under

Section 33 of the Kerala Co-operative Societies Act was initiated

and part time administrator was appointed on 22/11/2006 for a

period of six months. By Ext.P2 the period of the administrator

was extended for another six months. The period under Ext.P2

will expire on 21/11/2007 and therefore petitioner prays that

election may be held before 21/11/2007.

Today, when the matter came up, learned Government

Pleader submits that an order under Section 71 has been passed

on 22/10/2007 by which the society itself has been liquidated and

liquidator has taken charge. In the light of this development,

I feel that petitioner may not be entitled to seek the relief sought

for as long as the order of liquidation stands. The writ petition is

disposed of directing the first respondent to serve a copy of the

order passed under Section 71 and the order passed appointing

the liquidator to the petitioner within a period of one week from

the date of receipt of a copy of this judgment. I am not

pronouncing on the contentions of the petitioner in view of the

order passed under Section 71 and I leave those contentions

open.
