                  W.P(C).Nos.10595 & 10641 of 2009
                     ==================
Dated this the 2nd day of April, 2009

The petitioners in these two writ petitions are legal heirs of late

Sri.P.K.Narayanan, who held FL3 licenses at Polakulath Tourist Home,

Kodungallur and Polakulath Tourist Home, Ernakulam. He died on

26.3.2009. Accordingly, both the bars are closed from 26.3.2009

onwards. The petitioners have filed applications for endorsement of

their names in the licences as legal heirs of late P.K.Naranayan. Since

the applications have not been considered, the petitioners have filed

these writ petitions seeking a direction to the Excise Commissioner to

pass orders on the same. According to the petitioners, under the

Abkari Act and Rules, legal heirs have got a right to have licenses

issued in their names as successors-in-interest of the deceased original

licensee.

2. I have heard the learned counsel for the petitioner also.

She confirms that applications have been received from the

petitioners.

3. In the above circumstances, these writ petitions are

disposed of directing the Excise Commissioner, Thiruvananthapuram,

to consider and pass orders on the applications submitted by the

petitioners as expeditiously as possible, at any rate, within two weeks

from the date of receipt of a certified copy of this judgment.
