                          J U D G M E N T

These writ petitions carry similar issues for

consideration and therefore, they were heard jointly and are

being disposed of by this common judgment. The petitioners

in both these writ petitions are retirees from the service of

the Kerala State Road Transport Corporation. They have

retired from its service on diverse dates. After their

retirement from service pursuant to bipartite agreement

entered into between the Corporation and its employees, their

pensionary benefits were revised with effect from 1.3.2006

subject to the condition that monitory benefits would be paid

only with effect from 1.4.2009. The claim of the petitioners in

these writ petitions is for the revised pensionary benefits with

effect from 1.4.2009 in terms of the aforesaid bipartite

agreement.

2. I have heard the learned counsel appearing for the

petitioner as also the learned Standing Counsel appearing for

the Corporation.

3. Admittedly, the issue involved in these writ petition is

covered in favour of the petitioners by a Division Bench

judgment of this Court in Writ Appeal No. 210/2010 and

Ext.P6 judgment. In the said circumstances, these writ

petitions are disposed of as hereunder:-

There will be a direction to the respondents to re-fix the

pensionary benefits payable to the petitioners in terms of

bipartite agreement by which such pensionary benefits were

revised with effect from 1.3.2006 and to disburse arrears due

to them with effect from 1.4.2009, expeditiously, at any rate,

within a period of one month from the date of receipt of a copy

of this judgment. In case of failure on the part of the

respondents to disburse the benefits as directed above, the

arrears of pension payable to the petitioner would carry

interest @ 6% from 1.6.2009.

Disposed of accordingly.
