Writ Petition is filed praying to issue a Writ of Certiorari calling for the entire records relating to the impugned order passed by the respondent in his proceedings No.7/2006 Sa.Pa.1, dated 25.4.2007 and quash the same in so far relates to petitioner is concerned.

The competent authority in exercise of power under Section 87 of the Co-operative Societies Act 1983 initiated surcharge proceedings and passed the order on 25.4.2007 against the petitioner for recovery of certain amount. Such proceedings were communicated to the petitioner by Registered Post with a proper acknowledgment as could be seen from the order itself. As against the order passed by the competent authority under section 87 of the Co-operative Societies Act an appeal is provided under Section 152(1) of the Act. The petitioner has not preferred such appeal. The petitioner has delayed the matter for more than two years and 10 months and has approached this Court challenging the impugned proceedings.

In view of the inordinate delay and laches on the part of the petitioner in challenging the impugned proceedings received in the year 2007 itself, this Court is not inclined to entertain the writ petition. Further no reason has been given as to why he failed to approach the appellate forum. The writ petition is vague and bereft of details. In such view of the matter, the writ petition is liable to be dismissed only on the ground of inordinate delay and laches in prosecuting the claim. Accordingly, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petitions are closed.
