02. 07.10.2010. Heard the learned counsel for the petitioners
and learned A.P.P. for the State.
The petitioner, Pankaj Singh, is in custody
since 17.07.2009 in connection with Sessions Case
No.984 of 2009 (Correspondent to Belhar, Kheshar P.S.
Case No.149/05) instituted under Sections 364 (A),
307, 353/34 of I.P.C. and 27 of the Arms Act.
According to F.I.R., this petitioner along with
co-accused persons with rifle and pistol came and
demanded rangdari of Rs.2 lakhs from the informant.
It is said that the accused persons were taking the
informant to kill but in the meantime, police came and
rescue the informant. The accused persons fired at the
police and then fled away.
The learned counsel for the petitioner
submitted that the petitioner is in custody since more
than one year and the informant has been examined in
the trial who has not named the petitioner. The
evidence of the informant has been annexed as
Annexure-3 to the bail application.
Considering the nature of allegation and period
of detention, I direct that the petitioner named above

be released on bail on furnishing bail bond of
Rs.10,000/- (Rs.Ten Thousand) with two sureties of the
like amount each to the satisfaction of A.D.J., F.T.C.-2,
Banka in connection with Sessions Case No.984 of 2009
(Correspondent to Belhar, Kheshar P.S. Case
No.149/05) on condition that the petitioner should be
present physically before the trial Court on each and
every date failing which the bail grant of the petitioner
shall be cancelled by the Court below and the petitioner
be taken into custody.
