Heard learned counsel for the petitioner and
learned counsel for the State.
Petitioner is found in joint possession of stolen
motorcycle and exclusive possession of a loaded pistol.
Submission of the learned counsel for the petitioner is that
after recovery of motorcycle, section 414 of the I.P.C. was
added in the case for theft of a motorcycle vide Farbesganj
P.S. Case No. 341 of 2010 in which he is on bail and in
present case for having a loaded country made pistol, he is
in custody since 10.09.2010.
Taking that into consideration, prayer of the
petitioner for bail is allowed.
Let the above named petitioner be enlarged on
bail on furnishing bail bond of Rs. 10,000/- (ten thousand)
with two sureties of the like amount each to the
satisfaction of C.J.M., Araria in connection with Araria
(Bairgachhi) P.S. Case No. 398 of 2010.
