3. 30-06-2010 Heard learned counsel for the petitioner. Nobody

appears on behalf of the state.

Petitioner has renewed prayer seeking bail in a case

instituted under section 392 of the Indian Penal Code as his earlier

bail application was considered and rejected vide order dated

5.08.2009 passed in Cr. Misc. no. 18311 of 2009(Annexure-1).

While rejecting his prayer for bail he was granted liberty to file

bail application afresh after seven months.

Status report called for in this case indicates that only two

witnesses have till date been examined. Petitioner is in custody

since 29-01-2009.

Considering the period of detention and the defence taken

by him as would reflect from the order dated 5.08.2009, this court

is now inclined to admit him on bail.

Let the petitioner above named be released on

bail on furnishing bail bond of Rs. 10,000/- with two sureties of

the like amount each to the satisfaction of the learned Judicial

Railway Magistrate, Khagaria in connection with Bihpur Rail P.S.

Case No. 46/08 corresponding to G.R. (R) No. 163/08; subject to

the conditions that (i) one of the bailors shall be his own close

family members; (ii) the petitioner shall appear in person on the

date fixed at the trial. In case of default in such appearance on two

consecutive dates the trial court shall have liberty to cancel the

bail bond of the petitioner and secure his arrest in accordance with

law.
