The petitioner is working as Safai Karamchari in Market

Committee, Sunam, since 5.11.1975. His case is that he belongs to

Scheduled Caste category and as such is entitled to be considered for

promotion against 20% quota for promotion to the post of Clerk amongst

Class-IV employees. It is the case of the petitioner that he is fully eligible to

be considered for the said promotion, but the respondents are not

considering his claim. It is stated that in this regard, the petitioner has made

representation dated 27.1.2009 to respondent No.2, copy of which has been

annexed as Annexure P-2, but the same has not been considered and

decided so far. Counsel for the petitioner states that at this stage, the

petitioner will be satisfied, if a direction is issued to respondent No.2 to
CWP No. 12101 of 2009 -2-

consider and decide the aforesaid representation, expeditiously.

In view of the above, without issuing notice of motion as it will

un-necessary delay the matter, this petition is disposed of with a direction to

respondent No.2 to consider and decide the representation dated 27.1.2009

(Annexure P-2) expeditiously, preferably within a period of three months.
