Order.
Mr. Samir Mathur, IAS, Financial Commissioner and Principal
Secretary to Government of Haryana, is present in Court. He has assured
this Court that in future, all communications addressed to the Department by
the High Court or Advocate General’s office shall be responded quickly.
In view of above, his appearance is exempted. He has also
filed an affidavit on record, which reads thus:
“1. That Draft reciprocal Transport Agreement between Utter
Pradesh and Haryana had been prepared and signed by both the
States. The Haryana State has already notified draft agreement
on 5.9.2008 for inviting objections/ suggestions.
2. That the objections/ suggestions so received, to decide the
CIVIL WRIT PETITION NO. 6716 OF 2009 -2-objections, an opportunity of personal hearing was also
afforded on 17.10.2008.
3. That the objections received have also been decided by the
Financial Commissioner & Principal Secretary to Govt.
Haryana on 24.2.2009.
4. That though the State of Haryana and State of Uttar
Pradesh have agreed on the finalization of the reciprocal
agreement (draft signed on 22.7.2008), yet some operational
issues are in the final stages of being settled. Therefore,
agreement will be finalized and signed very soon.”
Shri Mathur further admits that process to implement reciprocal
agreement between the States of Haryana and U.P. is not yet complete. He
has assured this Court that till such time the agreement is legally
implemented, nobody shall be allowed to ply a bus(es), under cover of that
agreement and if there exists some earlier arrangement to ply buses on the
routes in question, the same shall not be disturbed. This satisfies the
petitioner. Writ petition stands disposed of accordingly.
