Allowed as prayed for.

CM No. 12864 of 2009:

This application has been filed with a prayer to implead the

applicant as one of the respondents. It is contention of counsel for the

applicant that the applicant, being a correspondent appointed under the

provisions of Education Code, to run the Institution(petitioner) is a

necessary party. To this prayer, counsel for the petitioner has not raised any

objection. Accordingly, this application is allowed and applicant is ordered

to be impleaded as respondent No. 9, in this writ petition.
CWP No. 8324 of 2009:

By filing this writ petition, a prayer has been made that

directions be issued to the respondents to auction vacant agricultural land,

which is ownership of the petitioner – School, in a transparent manner.

Counsel for the respondent No. 9 has put on record photo copies of the

proceeding register and receipts of the HDFC Bank for deposit of amount,

to show that the land in question was put to auction under his supervision

on April 26, 2009, for an amount of Rs. 6,21,000/-. It has further been

stated that the entire amount is lying deposited in the HDFC Bank at Mansa.

If that is so, this writ petition has become infructuous.

In view of above, this writ petition is disposed of by issuing

direction to respondent No. 9 to deposit amount of Rs. 6,21,000/- in Fixed

Deposit, in the H.D.F.C. Bank, fetching the highest rate of interest. He shall

not spend the amount in question till litigation comes to an end.

With above mentioned observation, this writ petition stands

disposed of.
