The present writ petition was filed by Parveen Kumar Gupta,

Technical Manager of Haryana State Electronics Development

Corporation Limited, Chandigarh (hereinafter referred to as “the

Corporation”) with a prayer that respondents be directed to fill up the post

of Senior Technical Manager by way of promotion from the Technical

Managers working in the Corporation. It was further prayed that

operation of advertisement issued by the Corporation on 4.11.1988

calling for application to fill up the post of Senior Technical Manager, be

set aside.

Admittedly, no order of stay was passed by this Court.

Therefore, in pursuance of advertisement issued in 1988 selection

procedure must have been carried and a selectee ought to have been

appointed. It has been averred in the writ petition that respondent No.3

was appointed as Technical Manager and he was granted more pay.

Since the prayer was confined in the writ petition that no

person should be appointed Senior Technical Manager directly in

pursuance of advertisement and the post be filled up through the

Technical Managers available, I am of the view that this prayer cannot be

entertained. No rules have been placed on record to say that this post is

to be filled up by promotion alone.

Therefore, there is no merit in the present writ petition and the

same is dismissed.
