Heard
learned counsel for the applicant.

It
is unfortunate on the part of the learned Tribunal in not depositing
90% of the amount as per the award dated 3-3-2007 passed in MACP
No.164 of 1998 making the applicant to approach the High Court by
way of filing the present Civil Application.

We
have gone through the order passed by the Tribunal. The order of the
Tribunal is very clear. We have also not disturbed the said order of
the Tribunal qua the above referred aspect of the matter. We do not
want to enter further into the matter but would direct the Tribunal
to invest the amount as per the order of the Tribunal.

Learned
Tribunal is directed to invest the remaining 90% amount forthwith
with any nationalized bank for a period of five years in the name of
the petitioner as directed by the Tribunal under intimation to this
Court. This application stands allowed accordingly.
