ORDER

1. The
present application under Section 5 of the Limitation Act, has been
preferred by the applicants – original appellants to condone
the delay of 166 days in preferring First Appeal challenging the
judgement and award dated 1/1/2010 passed by learned 3rd
Joint District Judge, Mehsana in Land Acquisition Reference Case
No.94/2002.

2. Having
heard Mr.K.M.Sheth, learned advocate appearing on behalf of the
applicants; Ms.Pathak, learned Assistant Government Pleader appearing
on behalf of respondent No.1 and Ms.Kalpana Brahmbhatt, learned
advocate appearing on behalf of respondent No.2 and considering the
averments in the application in support of the prayer to condone
delay in preferring the First Appeal and so as to give an additional
opportunity to the applicants to submit their case on merits rather
than non-shutting the same on technical ground of delay, delay caused
in preferring the First Appeal is hereby condoned. Rule is made
absolute accordingly. No costs.
