Heard
learned advocates appearing on behalf of respective parties.

The
prayer made in present petition by petitioner in paragraph 7(B) is to
direct respondent to grant deemed date from date of appointment in
temporary establishment along with consequential benefits of higher
grade as per Government Resolution dated 7th July, 1993.

For
very prayer, a detailed representation has been made by petitioner to
respondent on 28th February, 2011, page 24 to 29, which
has not been decided by respondent.

Therefore,
it is directed to respondents to consider representation dated 28th
February, 2011 made by petitioner while considering Government
Resolution dated 7th July, 1993 and examine service
details of petitioners and then to pass appropriate reasoned order in
accordance with law within a period of three months from date of
receiving copy of present order and communicate decision to
petitioner immediately.

In
view of above observation and direction, present petition is disposed
of by this Court without expressing any opinion on merits.

However,
it is made clear by this Court if ultimate decision is adverse to
petitioner, it is open for petitioner to challenge same before
appropriate forum by filing appropriate proceedings in accordance
with law.

Direct
service is permitted.
