1.0 On
19.02.2010, this Court has passed the following order:

This
matter was lastly listed for hearing on 27th
January 2010. On that day this Court has passed the following order :

At
the request of Mr.Bhavsar, ld. Counsel for the petitioner, S.O. to
19.02.2010.

Now
when this matter is listed today for final hearing, it is reported
that there is a sick-note of Mr.Bhavsar. Therefore, the
matter is adjourned to 23rd
February 2010. To be listed at Sr. No.1 in the Final Hearing Board.

It
is, however, made clear that if Mr.Bhavsar is not well on the next
date of hearing, he will make an alternative arrangement for
appearing in the matter.

2.0 Today
also, when the matter was called out, neither the learned advocate
for the petitioner has appeared nor any alternative arrangement has
been made by him. It appears that the learned advocate for the
petitioner is avoiding hearing of the matter.

3.0 Hence,
the present petition stands dismissed for default. Rule is
discharged. The interim relief, if any, stands vacated.
