Mr.J.M. Patel, learned counsel holding brief of Mr.A.J. Patel,
learned counsel for the petitioner; Mr.N.J. Shah, learned Assistant
Government Pleader for respondent Nos.1 and 5 and Mr.R.R. Marshall,
learned Senior Counsel assisted by Mr.Adil Mirza for respondent
No.6.

During
the course of hearing today, Mr.N.J. Shah has drawn the attention of
the Court to the affidavit filed on behalf of the respondent-State
as well as the communication dated 27th September 2011,
whereby it transpires that the proceedings for publication of
notification under Section 4 of the Land Acquisition Act have been
commenced.

In
view of aforesaid communication dated 27th September 2011
since the proceedings for publishing the notification under Section
4 have already commenced, present petition has become infructuous
and the same stands disposed of having become infructuous. Notice is
discharged with no order as to costs.
