Heard learned counsel for the applicant and learned AGA for the State.
It is contended that co-accused Smt. Anjana has been granted bail by this
Court in Criminal Misc. Bail Application No.31042 of 2009 vide order dated
2.2.2010 and since the role assigned to the applicant is identical to that of the
co-accused Smt. Anjana, he is also entitled to bail on the ground of parity.
The aforesaid factual aspects of the matter has not been disputed by the
learned AGA
After having considered the rival submissions made on behalf of the applicant
and the fact that the role of the applicant is similar to that of the co-accused
Smt. Anjana who has been granted bail by this Court, I am of the view that
the applicant is also entitled to be enlarged on bail on the ground of parity.
Let the applicant Patwari @ Raj Kumar involved in Case Crime No. 478 of
2009 under Section 364 IPC., P.S. Partapur, District Meerut be released on
bail on his executing a personal bond and furnishing two sureties each in the
like amount to the satisfaction of the court concerned subject to the following
conditions :-
1. The applicant shall record his attendance before the concerned CJM on
the 7th day of every month.
2. The applicant shall not tamper with the prosecution evidence.
3. The applicant shall co-operate in the early conclusion of the trial and
will not seek any unnecessary adjournments.
In case of breach of any of the above conditions, the trial Court will be at
liberty to cancel the bail.
