Pawan Kumar vs State Of U.P. And Others on 3 August, 2010
Court No. - 38

Case :- WRIT - A No. - 45312 of 2010

Petitioner :- Pawan Kumar
Respondent :- State Of U.P. And Others
Petitioner Counsel :- V. K. Singh,G. K. Singh
Respondent Counsel :- C. S. C.

Hon'ble Shishir Kumar,J.

Heard learned counsel for the petitioner and learned Standing Counsel.

Petitioner alleged to be selected for the purposes of appointment on the post
of Constable in 2007. He was examined by the Medical Board, but rejected.
Subsequently on the basis of order passed by this Court he was re-examined
and has been declared colour blind. Now, petitioner after a lapse of about one
year is filing the present writ petition claiming that respondents may be
directed to constitute a Medical Board and petitioner may be examined again.
Petitioner has also placed reliance upon an order of this Court passed in Writ
Petition No.17961 of 2010 in which by order dated 07.04.2010, this Court has
directed the authority concerned to constitute a Medical Board and take
appropriate decision after examination of the petitioner.

After considering the submissions of the petitioner, I am of the opinion that it
is a selection of 2007. Petitioner has been twice rejected medically and it has
been held that he is colour blind. The rejection order was of 2009. About one
year has been passed, therefore, now I am of the opinion that at this stage no
relief can be granted to the petitioner being the fact that selection is of 2007. It
must have been finalized and the selected persons have already joined the
post.

The writ petition is devoid of merits and is hereby dismissed.

No order as to costs.

Order Date :- 3.8.2010
