Heard Sri Amarjeet Upadhyay and Sri Q.V. Ahmad learned counsels for the
applicant, learned AGA and perused the record.
Counter affidavfit and rejoinder affidavit filed today, is taken on record.
Counsel for the applicant submitted that the applicant was falsely implicated.
In fact there was a love affair and even the marriage was solemnized.
Subsequently, on the pressure of the family member, false allegation was
made against the applicant. According to medical report she was aged about
18 years. Hence she was major and was consenting party. There was no mark
of injury on the external or internal part of body. However, the applicant is in
jail since 15.1.2009.
In view of the aforesaid fact without expressing any opinion on merit, let the
applicant Pawan alias Pappi be released on bail, in case crime no. 23 of 2009,
under Sections 363, 366, 376, 506 I.P.C., P.S. Singhawali Ahir, District-
Baghpat, on his furnishing a personal bond and two sureties each in the like
amount to the satisfaction of the court concerned.
