Heard learned counsel for the petitioner and the learned standing
counsel.
The first submission is that the petitioner was at serial no.1 in the
waiting list of the selection of 2004 therefore his claim ought to have
been considered.
The second submission is that in the fresh selections which have been
held the petitioner was entitled for consideration.
Having considered both the submissions, the first contention deserves
to be out right rejected as there is no perennial source of recruitment.
The selection cannot now be considered on the strength of a select list
of six years hence as neither there is any rule nor any law which may
permit such an exercise.
The claim of the petitioner with regard to fresh selections, it is evident
that the petitioner has himself appeared in a fresh selection therefore
the selection of 2004 does not survive. There is no error much less a
legal error pointed out against the subsequent selections as such the
second contention is also without force.
In view of the aforesaid the writ petition is dismissed.
