2. 23.9.2011 Heard learned counsel for the petitioner and learned

counsel for the State.

It has been pointed out by the learned counsel for the

petitioner and the State that the present case is completely covered

by the decision of the Division Bench rendered in L.P.A. No.

831/2009 along with other analogous cases dated 28.6.2011.

In view of the above statement, this writ petition is

disposed of with the observation that if the case of petitioner

comes within the parameters of law decided by the said Division

Bench, the case will be considered in the light of the said decision.
