This is a petition under Section 438 Cr.P.C. for grant of

anticipatory bail in case registered vide FIR No.109 dated 12.5.2009 under

Sections 448, 454, 511 and 34 IPC at P.S. Sector 11, Chandigarh.

The aforesaid FIR has been registered on the complaint of one

Joginder Kaur, who has stated that she is the owner of House No.255,

Sector 11-A, Chandigarh. The said house was vacant and was locked.

During the absence of the complainant, the petitioner has occupied the

house illegally for that she sought action against him.

Before coming to this Court, the petitioner has applied for

anticipatory bail before the Court below, which was dismissed by the

Additional Sessions Judge, Chandigarh vide order dated 2.6.2009.

Though the petitioner was granted interim bail but the

petitioner has not joined the investigation and it has been brought to the

notice of this Court that the petitioner has been booked in another case of
CRM-M No.15975 of 2009 -2-

similar nature vide FIR No.32 dated 1.7.2009.

Keeping in view the act and conduct of the petitioner as well as

his antecedents and the seriousness of the offence, I do not find it to be a fit

case for grant of anticipatory bail. Therefore, the petition is hereby

dismissed.
