                                O R D E R

This is an application for bail under Section 439 of the Code of

Criminal Procedure. The petitioner is the accused in Crime No.272

of 2009 of Kanjiramkulam Police Station.

2. The offence alleged against the petitioner is under Section

307 of the Indian Penal Code.

3. The date of occurrence was on 15.10.2009. The accused

is the father of the victim. The allegation is that while the victim was

sleeping on the seashore, the accused poured petrol on him and

ignited. The victim sustained serious burn injuries. He was admitted

in the hospital. Learned Public Prosecutor submitted that though the

victim is out of danger, he is still continuing in the hospital as an

inpatient.

4. In the facts and circumstances of the case as revealed from

B.A. NO. 6703 OF 2009

the case diary, it may not be proper to release the petitioner at this

stage, particularly when the victim is still in the hospital. It is

submitted by the learned Public Prosecutor that the life of the victim

would be in danger if the petitioner is released on bail.

For the aforesaid reasons, the Bail Application is dismissed.
