petition has been filed for restoration of Special Civil Application
No. 1455 of 1998 which was dismissed for non-prosecution in absence
of the counsel on 23.6.2009. The respondents were served through
their respective counsel. They have not filed any application
opposing the prayer.

Having
heard the counsel for the petitioner and taking into consideration
the ground shown and being satisfied with the ground, the petition
for restoration is allowed. Special Civil Application No. 1455 of
1998 is restored to its original file.

This
Misc. Civil Application stands disposed of.
