2 12. 08. 2010. Heard learned counsel for the petitioners and the State.

The petitioners are apprehending their arrest in a

complaint case in which cognizance has been taken under Sections

323, 354 and 504/34 of the Indian Penal Code and Section 3 of the

Prevention of Witch (Daain) Practices Act, 1999.

It is alleged that petitioners being family members of the

complainant assaulted the complainant, since the complainant was

practising the Witch (Daain) Craft.

Considering the nature of allegations and both sides

being family members, let the above named petitioners be released

on bail in the event of arrest or surrender in the court below within a

period of twelve weeks from today, on furnishing bail bond of Rs.

10,000/- (Ten thousand) each with two sureties of the like amount

each to the satisfaction of the Chief Judicial Magistrate, Bettiah

West Champaran, in connection with Tr. No. 2784 of 2010 arising

out of Complaint Case No. 1337 of 2009, subject to the conditions

as laid down under Section 438 (2) of Cr.P.C.
