This order governs the disposal of second bail application filed under Section 439 of Cr.P.C. by Shri Rajesh Kumar Advocate on behalf of the applicant Prabhudayal pertaining to F.I.R. No. 184/2008 at police station Sadar, Jaipur City (South), in the offence under Section 420, 406, 467, 468 and 120-B of IPC.

2. Heard the learned counsel for the petitioner, learned counsel for the complainant and learned Public Prosecutor appearing for the State and perused the material on record.

3. Learned counsel for the petitioner has contended that the petitioner has been falsely implicated and is in no way connected the commission of the offence of the instant case. He is an innocent person. He has been in custody for quite a long time, hence, he may granted indulgence of bail.

4. Learned Public Prosecutor appearing for the State as also learned counsel for the complainant have opposed the bail application.

5. Having considered the submissions made at the bar and scanned the relevant material on record, I without expressing any opinion on the merits of the case, do not feel inclined to grant bail to the petitioner and the same deserves to be dismissed.

6. In the result, the second bail petition filed under Section 439 of Cr.P.C. on behalf of the accused-petitioner Prabhudayal stands dismissed.
