Heard the parties and with their consent, this writ petition is
being disposed of at the stage of admission itself.
2. The whole grievance of the petitioners is that their cases for
promotion to the post of Forester from Forest Guard is not being
considered by the competent authorities in spite of the fact that they
have secured first with honours in Forest Training Examination in their
School and they fulfilled the criteria for promotion as laid down under
Clause 3.21 b of the Bihar Forest Manual – Volume – 2. It is said that in
spite of the fact that their cases have already been forwarded for
consideration for their promotion by letter dated 16.01.2003 as
contained in Annexure-5 issued under the signature of Conservator of
Forest, Hazaribagh Division, Hazaribagh, but their cases have not
been considered.
3. Mr. Rajendra Krishna, learned Sr. S.C.-I appearing for the
respondent State fairly submitted that since the matter for promotion
of the petitioners has already been forwarded to the Regional Chief
Conservator of Forest, Hazaribagh and therefore, their case would be
considered in accordance with law.
4. In view of the stand taken by the respondent – State, this writ
petition is being disposed of by directing the Regional Chief
Conservator of Forest, Hazaribagh to consider the cases of the
petitioners for their promotion to the post of Forester, pursuant to
Clause 3.21 b of the Bihar Forest Manual Volume-2 and decide the
claim in accordance with law by a reasoned order within a period of
eight weeks from the date of receipt of a copy of this order.
5. With the aforesaid observations and directions, this writ
petition stands disposed of.
