Heard learned counsel for the petitioners and learned counsel for the opposite
parties.
This petition under Article 226 of the Constitution of India has been filed by
the petitioners for quashing the impugned FIR related to case Crime No. 816
of 2010, under Sections 147, 148, 149, 504, 506, 452, 380, 427 I.P.C. and 7
Criminal Law Amendment Act at Police Station Jalalpur, District Ambedkar
Nagar.
Gone through the First Information Report. The allegations made in the FIR
disclose the commission of cognizable offence mentioned therein, therefore
no ground for quashing the FIR is made out. The petition is devoid of any
merit and is liable to be dismissed.
The petition is, therefore, dismissed.
Learned counsel for the petitioners submits that the police is mounting
pressure to arrest the petitioners, therefore, some protection be given to them.
Keeping in view the nature of offence, it is observed that in case the
petitioners appear before the court concerned within a week from today and
move any application for bail, the same shall be considered and disposed of
by the court preferably on the same day.
Till then, the Investigating Officer will not take coercive steps to arrest the
petitioners. If the petitioners fail to appear before the court concerned within
the time allowed by the Court, they will not be entitled to any protection.
