Heard the learned counsel for the petitioner and the learned
Standing Counsel.
The petitioner is aggrieved by the order of suspension dated
08.07.2010 pending inquiry levelling certain charges. According to
the petitioner the charges levelled against the petitioner are not
such serious which can lead to the order of dismissal, termination
and removal from service, therefore, the order of suspension is not
warranted.
I have considered the submissions of the petitioner and the leaned
Standing Counsel. Normally this Court in the order of suspension
does not interfere being the fact that suspension is no punishment
but in the facts and circumstances of the present case as the
petitoner has been suspended in the month of July, 2010 and the
inquiry against the petitioner has not yet been completed,
therefore, I am opinion that the disciplinary inquiry against the
petitioner be completed within two months after affording full
opportunity to the petitioner, in case the petitioner cooperates in
the inquiry.
If the disciplinary proceeding is not completed within a period of
two months, the suspension order will be kept in abeyance.
The writ petition is disposed of accordingly.
No order is passed as to costs.
