02 18.07.2011 Both the above stated petitions arise out of Khutauna
P.S. Case No. 06 of 2011 registered under various provisions of the
Arms Act, and, accordingly, both the above stated petitions are being
disposed of by this common order.
Heard learned counsel for the petitioners as well as
learned Additional Public Prosecutor for the State.
Allegedly, one country made pistol and three live
cartridges were recovered from conscious possession of petitioner in
Cr. Misc. No. 20045 of 2011 and similarly, one country made pistol
and five live cartridges were recovered from conscious possession of
petitioner in Cr. Misc. No. 22484 of 2011.
Petitioners are languishing in jail custody since
19.03.2011 and the impugned order of learned Sessions Judge
discloses that at Para 23 of the case diary, the antecedent of the
petitioners have been mentioned by the Investigating Officer but
submission on behalf of the petitioners is that they had been made
accused in a case on the basis of suspicion but subsequently, they
were acquitted after trial.
Considering the aforesaid facts and circumstances as

well as submissions of the parties, let the petitioners be released on
bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each
with two sureties of the like amount each to the satisfaction of
Additional Chief Judicial Magistrate, Jhanjharpur, Madhubani in
connection with Khutauna P.S. Case No. 06 of 2011.
