2. 1.9.2010 Heard learned counsel for the petitioner and the State

Petitioner is alleged for setting fire in hut. Now

submission of the learned counsel for the petitioner is that in earlier

rejection order the circumstance that part of the hut only was found

burnt and was not in use of human dwelling as it was under

construction shall be taken into consideration in regular side for

which earlier direction is there while petitioner’s prayer was rejected

by Cr. Misc. no.16965 of 2010. Any rejection order will not

prejudice this petitioner’s prayer.

This application is disposed of.
