COMMON ORAL ORDER

Learned
advocate Mr. Anshin H. Desai for the petitioner seeks permission to
withdraw these petitions in light of the order dated 22.07.2004
passed in Letters Patent Appeal Nos. 581 and 582 of 2001 in Special
Civil Application Nos. 1659 and 1657 of 2001 which are cognate
matters, reserving liberty to raise all available contentions before
the authority on the point of unreasonable delay in issuing the
notice under Section 8AA of the Bombay Prevention of Fragmentation
and Consolidation Act and other contentions on merits with a request
that the authority may decide the matter strictly in accordance with
law after affording an opportunity of being heard to the petitioner
and without being influenced by the observations made in the order.

Learned
AGP Mr. A.J. Desai for respondent No.1 and learned advocate Mr. Sunil
C. Patel for the District Panchayat do not object to the request.

Permission
as prayed for is granted and the petitions stand disposed of as
withdrawn. Rule is discharged. No costs.
