This petition is for bail.

2. The alleged offence is under Section 55 (i) of Abkari

Act. According to prosecution, petitioner was found in

possession of 1.75 litres of Indian Made Foreign Liquor for

sale on 14.11.2008 and he was arrested on the same day.

3. Learned Public Prosecutor submitted that the

petitioner is involved in 2 other cases in the years 2004 and

2006. Hence stringent conditions may be imposed but he has

no objection in granting bail.

On hearing both sides, I am satisfied that bail can be

granted on conditions.

Hence, the following order is passed :

Petitioner shall be released on bail on his

executing bond for Rs.25,000/- with two solvent

sureties each for like sum to the satisfaction of the

Magistrate court concerned on the following

conditions :

(i) Petitioner shall report before Investigating

Officer on every Monday, Wednesday and

Saturday between 10 a.m. and 1 p.m. until

further orders.

(ii) Petitioner shall not commit any offence while

on bail and in case of breach of this condition,

bail is liable to be cancelled.

The petition is allowed.
